Proposed Amendments to the Public Sector (Governance) Act for Agencies to Share Data with External Partners

The Ministry of Digital Development and Information (“MDDI“) conducted a public consultation from 12 August 2025 to 2 September 2025 on proposed amendments to the Public Sector (Governance) Act 2018 (“PSGA“), which aim to provide a clear legal basis for public sector agencies to share data with authorised external partners.

At present, the PSGA only provides a legal basis for data sharing across the public sector. However, the Government has been increasingly working closely with external partners, including community groups and other private sector partners. To allow these external partners to deliver such services more effectively, the amendments seek to provide for the sharing of relevant data with them, with appropriate safeguards.

The proposed amendments include the following:

  1. Enabling public sector agencies to authorise an external partner to receive data that is required for the services they are delivering;
  2. Establishing safeguards so that the data shared with external partners is protected and handled responsibly, including through the imposition of data governance requirements and criminal penalties for the unauthorised disclosure and improper use of information; and
  3. Continued application of the Personal Data Protection Act 2012 obligations.

Separately, MDDI will also be making amendments to clarify that public sector agencies may use internally the data which they are allowed to share with other public agencies.
